TERMS & CONDITIONS OF SALE AND DELIVERY
These terms of sale and delivery apply to all offers and orders placed via Claudia Lindby, unless these have been deviated from by express written agreement between the parties. The buyer’s statements of their own terms in emails, regular letters, orders, orders, confirmations, etc. are not considered a valid deviation from the terms of sale and delivery. Claudia Lindby reserves the right to make minor changes and additions to the agreed terms of sale and delivery.
1. ORDER CONFIRMATION
Agreement between the buyer and Claudia Lindby is considered concluded when Claudia Lindby has sent an order confirmation. Any objections by the buyer to the content of the confirmation must be in writing and reach Claudia Lindby no later than 5 business days after the date of the confirmation.
2. PRICE AND PAYMENT TERMS
Offers are binding on Claudia Lindby for 14 days from the date of the offer, unless otherwise expressly stated in the offer. Invoices are sent upon receipt of the order and must be paid within 14 days.
In the event of an agreement on a longer period of time (more than 3 months from first to last delivery) and orders over DKK 100,000, it can be agreed that 50% is invoiced upon receipt of the order and paid within 14 days, while the remaining part is invoiced in connection with the main delivery and paid within 14 days thereafter.
Payment after due date, interest is calculated on the invoice amount at 1/6 of the discount rate applicable at any time per commenced month, however with a min. 1.75% per commenced month applicable from the due date.
3. MOVEMENTS OF IN-HOUSE PROGRAMS1)
If the buyer wishes to move dates for consultancy services / in-house programs, this can be done by agreement with Claudia Lindby up to 3 months in advance. When programs are postponed at the buyer’s request, however, the payment terms for the originally agreed course apply. If the buyer wishes to move dates later than 3 months in advance, Claudia Lindby has the right to consider this as a cancellation (see point 4), or choose to invoice for lost earnings.
For individual Executive Coaching agreements, the customer will be able to move the individual agreed time up to 48 hours before the agreed time without cost.
4. CANCELLATION OF IN-HOUSE PROGRAMS
Cancellation of consultancy services / in-house programs must be made in writing, stating the invoice number. If cancelled earlier than 3 months before the first day, the entire program price will be refunded minus an administration fee of 10%. If cancelled later than 3 months before the first day, no part of the program price will be refunded.
5. IMPLEMENTATION OF IN-HOUSE PROGRAMS
No refund will be given if the buyer chooses not to use parts of the program.
6. CANCELLATION OF IN-HOUSE PROGRAMS
If part of an In-House program is canceled by Claudia Lindby because the consultant/instructor is ill/disabled/absent, and a suitable substitute cannot be organized, Claudia Lindby will arrange replacement program days to the greatest extent possible.
7. MOVE PARTICIPATION IN OPEN2) PROGRAMS
If the buyer wishes to move their participation in open programs, this can be done by agreement with Claudia Lindby up to 4 weeks before the first program day. If participation is postponed at the buyer’s request, however, the payment terms as agreed for the originally agreed program course apply.
If the buyer wishes to move their participation later than 4 weeks before the first program day, Claudia Lindby has the right to consider this as a cancellation (see point 8).
8. CANCELLATION OF OPEN PROGRAMS
Cancellation of programs must be made in writing, stating the invoice number. If canceled earlier than 6 weeks before the first program day, 90% of the program price will be refunded. If canceled later than 6 weeks and earlier than 4 weeks before the first program day, 50% of the price will be refunded. If canceled later than 4 weeks before the first program day, no part of the program price will be refunded. If the buyer is prevented from participating, the buyer is welcome to send another participant from the company upon prior written notification to Claudia Lindby.
9. IMPLEMENTATION OF OPEN PROGRAMS
No compensation will be provided if the buyer chooses not to participate in all or part of the program.
10. OVER-SUBSCRIBE/CANCELATION OF OPEN PROGRAMS
In the event of oversubscription or insufficient registrations, Claudia Lindby reserves the right to postpone or cancel the program with 3 days’ notice.
If parts of a program or a single program day are canceled because the instructor is ill/disabled/absent, and a suitable substitute cannot be organized, Claudia Lindby will arrange replacement days/parts to the greatest extent possible.
If Claudia Lindby does not offer replacement day(s), a refund of a proportional part of the program fee will be offered instead.
11. COMPLAINT
If the buyer believes that the program course or consulting service provided does not correspond in substance to what was offered, and therefore wishes to claim a refund of part of the fee paid, a written complaint must be submitted so that it can reach Claudia Lindby no later than 6 business days after the end of the delivery.
12. LIMITATION OF LIABILITY
The buyer is hereby informed that although the services and programs at Claudia Lindby aim at personal development, they have no therapeutic purpose, and Claudia Lindby, affiliated consultants and/or sub-suppliers disclaim to the greatest extent possible any liability for unintended results in this field and any lack of personal development for individual participants.
As part of the intention of the programs is a high degree of personal development, the various programs may contain elements that are offensive to some. This is part of the methods that the individual instructor can use to provide the best possible learning situation for participants in general.
The buyer is also made aware by these terms of sale that participants who may have mental and/or physical problems should seek help from the appropriate authority, such as a doctor or psychologist, and should refrain from participating in the programs.
The buyer is also made aware that Claudia Lindby may serve/has served customers in the same or similar industry as the buyer, both through programs and through consulting services, and that this cannot give rise to claims for damages or other claims against Claudia Lindby in this regard. Furthermore, the buyer is responsible for highlighting in writing any confidential information or circumstances that are specifically desired to be kept secret from competitors or the like, but which are considered necessary to present to the consultant/instructor.
13. FORCE MAJEURE
Neither party is entitled to compensation or to terminate the agreement in the event of non-performance or inadequate performance if this is due to force majeure, which could not or should not have been foreseen by the parties at the time of entering into this agreement or related agreements.
14. PROGRAMME MATERIAL, ETC.
Claudia Lindby reserves the right to make changes to the design and content of programme material, etc. at any time, provided that the changes in question do not significantly impair the buyer’s or programme participants’ ability to use the purchased item in the context of the programme.
15. APPLICABLE LAW AND JURISDICTION
Any disagreement or dispute between the parties regarding the understanding and scope of these sales and delivery provisions shall be settled by the Maritime and Commercial Court in Copenhagen under the application of Danish law.

My personal path from clarity to impact
Some years ago, in the aftermath of a major and much-needed business restructuring, it became painfully obvious that the way we – the C suite – had approached it, although highly “professional”, had led to failure. The perfect strategy we had developed led to no real changes in how we operated, nor the results we were getting. We never achieved what we aspired to, and the costs were significant on all levels: value share, employee motivation, brand reputation, financials…
This was not the first time we failed, nor was it the last – despite clever thinking, solid plans and good resource allocation.
Over the years, every day, our fine-tuned systems and processes supporting business development, performance management and people development more often than not led to frustration, anger or indifference rather than helping us achieve what we really wanted for business and for people. I experienced a need to integrate “hard performance” with “soft skills”: we worked harder and harder, often getting only incremental improvements – and often exhausting ourselves along the way. The difference between good leadership and poor leadership was all too obvious, and High-Performance Teams were an exception rather than the norm.
I was convinced we could do much better! I wanted to redefine Performance. For myself, and for the business. But I did not know how.
Until one day, in my search, I came across a different approach. Looking at business a human enterprise, I began to see not only how “old transactional business” differs from “new transformational business” – but also what becomes possible as we leave behind artificial hierarchies, the illusion of control, our limiting focus on KPI’s, etc. and embrace new leadership thinking and practices that are more aligned with what it means to be human.
This path has led me to develop the Evolutionary Leadership Growth Path, and today I join forces with purpose-driven leaders, open-minded pioneers, successful implementers. We explore, challenge and develop the concept of Performance to achieve what matters and to create the greatest possible positive impact.
We redefine and redesign how we work, in the day-to-day, with Performance for individuals, teams and organizations.
